1. General provisions
1.1. These Terms of Service govern access to and use of the website available at warsawinvestor.care (the "Website"), operated by Flip Activ Sp. z o.o. (the "Operator").
1.2. The Website is an informational and marketing platform presenting advisory services for foreign buyers in the Warsaw residential property market. The Website does not constitute an offer within the meaning of Article 66 of the Polish Civil Code.
1.3. Use of the Website is voluntary and free of charge. No registration is required.
1.4. By using the Website, the User confirms that they have read and accept these Terms.
1.5. These Terms are available at all times at warsawinvestor.care/legal.
2. Definitions

- Website — the website warsawinvestor.care and all its subpages and content.
- User — any natural person, legal person or unincorporated entity that accesses the Website.
- Content — all text, graphics, photographs, video and other materials published on the Website.
- Services — advisory and coordination services for Warsaw property acquisition provided by the Operator under separate agreements.
- Contact Form — an interactive form on the Website enabling Users to submit enquiries to the Operator.
- GDPR — Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.
3. Nature of the Website and services
3.1. Warsaw Investor Care is a marketing and advisory platform supporting foreign buyers in the Warsaw residential property market. The Operator provides acquisition coordination, developer outreach, property selection advice, legal coordination and renovation management services.
3.2. The Operator is not a licensed real estate broker under the Polish Real Estate Management Act to the extent that such Act requires a professional licence for brokerage activities. All property acquisition transactions are concluded directly between the User and the relevant developer, seller or notary.
3.3. Content published on the Website is for informational and marketing purposes only and does not constitute legal, tax, financial or investment advice. Market data, prices, tax rates and property information are indicative and subject to change.
3.4. The Operator is not a licensed financial adviser, mortgage broker or tax adviser. Information about mortgages, taxes and transaction costs published on the Website is of a general informational nature and must be verified with appropriate qualified professionals for any specific transaction.
4. Acceptable use
4.1. Users agree to use the Website in accordance with applicable law, these Terms and good practice.
4.2. The following are prohibited:
- taking actions that may disrupt the proper functioning of the Website,
- copying, reproducing or distributing Website Content without the prior written consent of the Operator,
- introducing malicious software or false data into the Website,
- submitting unlawful, offensive or spam content through contact forms,
- impersonating other individuals or entities.
4.3. The Operator reserves the right to refuse service or block access for Users who violate these Terms.
5. Intellectual property
5.1. All Content on the Website, including texts, graphics, photographs, logos, layout and visual design, is the property of the Operator or its licensors and is protected under the Polish Copyright and Related Rights Act of 4 February 1994.
5.2. Users may use Content solely for personal, non-commercial purposes within the scope of fair use under applicable copyright law. Any other use — including public distribution, reproduction, modification or commercial exploitation — requires the prior written consent of the Operator.
5.3. The name "Warsaw Investor Care" and the Website's logos are trademarks or designations used by the Operator. Their use without the Operator's consent is prohibited.
6. Contact forms and communication
6.1. Submitting a contact form constitutes consent to the processing of personal data for the purpose of responding to the enquiry, in accordance with the Privacy Policy.
6.2. The Operator will endeavour to respond to enquiries within 2 business days but does not guarantee a response to incomplete, incomprehensible or non-compliant submissions.
6.3. All correspondence conducted via the Website is pre-contractual in nature and does not constitute the conclusion of a contract unless the Parties expressly agree otherwise in writing.
7. Limitation of liability
7.1. The Operator takes care to ensure that information on the Website is accurate and up to date, but does not guarantee its completeness or accuracy. Market, legal and tax information may become outdated without prior notice.
7.2. The Operator is not liable for investment decisions made by Users on the basis of Website Content. Before making any property acquisition decision, Users should consult an independent lawyer, tax adviser and financial adviser.
7.3. The Operator is not liable for: interruptions in Website access due to technical issues, maintenance or force majeure; content of external websites linked from the Website; actions of third parties; or damages arising from use or inability to use the Website, except where caused by the Operator's wilful misconduct.
7.4. To the maximum extent permitted by law, the Operator's liability in connection with free use of the Website is excluded, except for damages resulting from intentional acts or gross negligence of the Operator.
8. Changes to these Terms
8.1. The Operator reserves the right to amend these Terms at any time. Changes take effect upon publication on the Website. Continued use of the Website following publication of changes constitutes acceptance of the updated Terms.
9. Governing law and disputes
9.1. These Terms are governed by Polish law. Disputes arising from use of the Website shall be resolved by the court with jurisdiction over the Operator's registered seat, subject to any mandatory consumer protection provisions. EU-resident consumers may use the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
9.2. In the event of any discrepancy between the English and Polish versions of any legal document on this Website, the Polish version shall prevail.
10. Final provisions
10.1. Matters not governed by these Terms are subject to Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services of 18 July 2002. If any provision is found invalid or unenforceable, the remaining provisions remain in force. These Terms enter into force on 3 June 2026.

2. Your rights
Every person whose data is processed by the Controller has the right to: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection (Art. 21) and withdrawal of consent at any time without affecting the lawfulness of prior processing.

3. Recipients of personal data
Personal data may be shared with: technical and hosting providers (WebWave CMS, e-mail provider); analytics tools (Google Analytics with IP anonymisation); Make (Integromat) automation platform for contact form handling; public authorities where required by law. The Controller does not sell personal data to third parties. Data processing agreements are concluded with all processors in accordance with Art. 28 GDPR.
4. International transfers
Some technical service providers may process data outside the EEA (e.g. Google LLC, USA). In such cases, the Controller ensures an adequate level of protection through Standard Contractual Clauses approved by the European Commission (Art. 46(2)(c) GDPR) or other lawful transfer mechanisms.
5. Security
The Controller applies appropriate technical and organisational measures to protect personal data against unauthorised access, loss, destruction or disclosure, in accordance with Art. 32 GDPR. The Website uses HTTPS encryption for data transmission.
6. Changes to this Policy

§1. Postanowienia ogólne
1.1. Niniejszy Regulamin określa zasady korzystania z serwisu internetowego warsawinvestor.care (dalej: „Serwis"), prowadzonego przez Flip Activ Sp. z o.o. (dalej: „Operator"). Serwis ma charakter informacyjno-marketingowy i prezentuje usługi doradcze dla zagranicznych nabywców nieruchomości w Warszawie. Nie stanowi oferty w rozumieniu art. 66 Kodeksu cywilnego.
1.2. Korzystanie z Serwisu jest dobrowolne i bezpłatne. Korzystając z Serwisu, Użytkownik akceptuje postanowienia Regulaminu.

§3. Charakter serwisu
3.1. Warsaw Investor Care to platforma marketingowo-doradcza wspierająca zagranicznych nabywców nieruchomości na rynku warszawskim. Operator świadczy usługi koordynacji zakupu, doradztwa przy wyborze nieruchomości, koordynacji prawnej i zarządzania procesem wykończenia.
3.2. Operator nie jest licencjonowanym pośrednikiem w obrocie nieruchomościami w zakresie wymagającym licencji zawodowej. Transakcje nabycia nieruchomości zawierane są bezpośrednio pomiędzy Użytkownikiem a deweloperem, sprzedającym lub notariuszem.
3.3. Treści Serwisu mają wyłącznie charakter informacyjno-marketingowy i nie stanowią porady prawnej, podatkowej, finansowej ani inwestycyjnej.
§4. Zasady korzystania z Serwisu
4.1. Użytkownik zobowiązuje się korzystać z Serwisu zgodnie z prawem, niniejszym Regulaminem i dobrymi obyczajami. Zabrania się m.in.: zakłócania działania Serwisu, kopiowania Treści bez zgody Operatora, wprowadzania złośliwego oprogramowania oraz przesyłania treści bezprawnych lub spamowych.
§5. Własność intelektualna
5.1. Wszelkie Treści Serwisu objęte są ochroną na podstawie ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych. Użytkownik może korzystać z Treści wyłącznie na własny użytek osobisty. Nazwa „Warsaw Investor Care" jest oznaczeniem używanym przez Operatora — jej użycie bez zgody jest zabronione.

3. Odbiorcy danych i transfery
Dane mogą być przekazywane: dostawcom usług technicznych (WebWave CMS, dostawca e-mail, Google Analytics z anonimizacją IP, platforma Make), organom publicznym na podstawie przepisów prawa. Administrator nie sprzedaje danych podmiotom trzecim. W przypadku transferów poza EOG stosowane są standardowe klauzule umowne zatwierdzone przez Komisję Europejską (art. 46 ust. 2 lit. c RODO).
4. Bezpieczeństwo i zmiany Polityki

4. Ograniczenie odpowiedzialności
