Canadian residence alone does not decide whether a Polish acquisition permit is needed. The answer depends on citizenship, the legal object being purchased and the exact title structure—before the reservation payment, power of attorney or international transfer is released.

A Canadian buyer can often purchase a Warsaw apartment—but the word “apartment” must match the legal title.

Polish law provides an exemption for the acquisition of an independent residential unit by a foreigner. That can cover a normal separately owned Warsaw apartment, but it should never be expanded into a promise covering every house, plot, co-ownership share, serviced unit, commercial unit or parking structure. The official starting point is the Polish Ministry of the Interior's current foreign-acquisition guidance.

The screen is based on the buyer's citizenship and the property right being acquired—not merely an address in Toronto, Vancouver, Montréal or Calgary. A Canadian resident who also holds Polish, EU/EEA or Swiss citizenship can have a different route, so every nationality and intended owner should be disclosed before any binding payment.

Separate residential apartment

A self-contained residential unit can fall within the statutory exemption. Confirm its separate title, KW, common-property share and all appurtenant rights before relying on it.

For a non-EEA Canadian citizen, direct acquisition of land or a house-and-land title normally requires an MSWiA route unless a separate statutory exemption applies.

A garage right linked to housing can be treated differently from a stand-alone commercial unit or share. The advertisement label is not enough; review the deed and register structure.

Dual citizen or company buyer

Multiple citizenships, corporate ownership and acquisition of shares in a property-holding company can materially change the analysis. Record the intended legal owner before search.

01 · Acquisition permission

The permit answer belongs to the deed file, not the listing description

“Apartment”, “loft”, “studio” and “investment unit” are marketing words. The legal question is what right the notarial deed transfers and whether the buyer's citizenship gives an exemption for that specific right.

What must be confirmed before a deposit

  • Every citizenship held by each intended buyer and whether the owner will be an individual or entity.
  • The right being acquired: separate ownership, cooperative right, co-ownership share, perpetual usufruct, land, house or commercial premises.
  • Whether parking and storage are appurtenant rights, separate premises, shares or contractual use rights.
  • Whether the property is in a border area or involves agricultural land, where statutory exclusions can matter.
  • If a permit is required, whether the buyer can prove the Polish ties and transaction facts requested by MSWiA.

MSWiA states that the general apartment exemption does not apply to property in a border area and agricultural land exceeding the statutory threshold. It also lists the information and foreign-language translations required when a permit application is necessary. Read the official English guidance before agreeing a completion date.

Citizenship ≠ residence

Living and paying tax in Canada does not by itself place the buyer inside or outside the EEA exemption. Passport status and the proposed owner matter.

Do not split the file

The buyer's agent, lawyer and intended notary should work from the same title description. Three different assumptions create one failed completion.

Reservation condition

If the permit position or legal title is not yet confirmed, the reservation and refund mechanics must preserve a real exit.

02 · Canadian documents

Draft in Poland first. Sign and apostille in the correct Canadian jurisdiction second.

A Canadian power of attorney can support a fully remote Warsaw purchase, but only when its Polish scope, Canadian execution, apostille, original-document chain and sworn translation are coordinated before the deadline.

The controlled POA chain

Polish Civil Code Article 158 requires notarial-deed form for a contract transferring ownership of real estate. Article 99 provides that when an act requires a special form, the authority to perform it must follow that form. The current wording is available in the official Civil Code text.

  • A Polish buyer lawyer prepares or reviews the exact authority for the intended transaction.
  • The intended Polish closing notary confirms the foreign form and wording they will accept.
  • The buyer executes the document before the correct Canadian professional.
  • The appropriate Canadian authority issues the apostille for the jurisdiction where it was notarized.
  • The original document reaches Poland and receives a sworn Polish translation where required.
  • The representative uses only the powers expressly granted and follows any price, property or conflict limits.
Canada joined the Apostille Convention

The convention entered into force for Canada on 11 January 2024. For documents destined for Poland, an apostille generally replaces the former multi-step legalisation route. Global Affairs Canada

Authority depends on province

Alberta, British Columbia, Ontario, Quebec and Saskatchewan issue apostilles for documents issued or notarized there. Other provinces and territories listed by the federal guidance route through Global Affairs Canada. Use the official triage instructions.

No generic template

Never notarize a broad online POA first and ask the Polish team to adapt it later. Apostille authenticates signature and capacity; it does not confirm Polish legal sufficiency.

A Canadian buyer controls risk by separating the property price from taxes, professional fees, conversion, legal execution and the capital needed to make the apartment usable or rentable.

Standard PCC rate: 2%

Poland's Ministry of Finance lists a 2% PCC rate for the sale of real estate and specified property rights. A statutory first-home exemption should be treated as fact-specific, especially when the buyer has owned housing in Canada or elsewhere. Official PCC rates

Confirm the gross price and tax structure

A developer price commonly includes VAT rather than a separate resale PCC charge, but the contract, property type and current tax treatment must be checked. Sixth-and-later-unit rules can also change the PCC result.

Exit planning starts at acquisition

Archive the deed, acquisition costs, PCC or VAT evidence, legal and WIC invoices, capital improvements, rental history and CAD conversions. Polish tax and Canadian gain calculations do not necessarily use identical amounts or dates.

Professional advice

Confirm both sides before filing

Use a Polish adviser for Polish obligations and a Canadian adviser familiar with foreign real estate for the Canadian return. A treaty identifies taxing rights; it does not complete either tax return for the owner.

Remote buying increases the standard of evidence

A polished video tour cannot verify ownership, pending register entries, building liabilities, illegal alterations, moisture, acoustic defects or whether the advertised rental model is lawful and realistic.

Match seller identity, marital or corporate authority, acquisition history and the right transferred. Read all sections and pending references in the land and mortgage register through the official EKW service.

Mortgage release and claims

Verify creditor figures, release documents, payment sequence, claims, easements and deletion mechanics rather than relying on a promise that the register will be “clean later”.

Building

Charges, resolutions and capital work

Review management charges, arrears, reserve fund, recent resolutions, litigation, major repairs and known building-system problems that can change the operating budget.

Unit

Area, layout and alterations

Match the legal unit, plans, storage, parking and actual layout. Investigate material wall, wet-area, ventilation or installation changes before treating them as an asset.

Condition

Defects and true completion cost

Inspect windows, moisture, heating, ventilation, plumbing, electrical installation, finishes and handover tolerances. Convert defects into cost, timetable and negotiation consequences.

The acquisition is incomplete until the apartment can operate without the owner in Poland

For a Canadian investor, layout, durability, tenant profile, maintenance access and management evidence matter as much as the headline purchase price. The property should be designed for the long-term rental market before fit-out begins.

Answers to the questions that should come before the reservation payment

These are general route answers. Citizenship, title, province of document execution, tax residence, ownership structure and property facts can change the result.

Can a Canadian citizen buy an apartment in Warsaw without an MSWiA permit?

Often yes when the acquisition is a normal independent residential unit covered by the statutory exemption. The exemption should be confirmed against the exact deed, land-register structure, parking or storage rights and buyer identity before reservation. A house, plot or unusual title can follow a different route.

Does living in Canada decide whether I need a Polish property permit?

No. Residence in Canada is not the same as Canadian citizenship, and neither should be inferred from a mailing address. The analysis should record every citizenship held by each intended owner and the exact property right being purchased.

Can I buy a Warsaw apartment without travelling to Poland?

Yes, a remote purchase can be possible through a properly drafted and accepted power of attorney. The Polish lawyer and intended notary should approve the exact authority before it is executed in Canada, apostilled by the correct authority and translated into Polish where required.

Where do I obtain a Canadian apostille?

It depends on where the document was issued or notarized. Alberta, British Columbia, Ontario, Quebec and Saskatchewan have designated provincial competent authorities; Global Affairs Canada handles federal documents and the provinces and territories listed in its guidance. Use the official federal triage route for the specific document.

Will a generic Canadian power of attorney work in Poland?

Do not assume it will. Polish real-estate transfers use notarial-deed form and the authority must cover the required acts with acceptable wording. An apostille authenticates the Canadian public document; it does not correct missing Polish powers or transaction detail.

Does a Canadian resident report Warsaw rental income in Canada?

CRA states that Canadian-resident taxpayers report income earned from foreign property regardless of its cost amount. Polish property income may also be taxed in Poland under the Canada–Poland convention. Obtain advice on returns, foreign tax credits and currency conversion for the owner's facts.

Does Form T1135 apply to a Warsaw rental apartment?

It can. Canadian-resident taxpayers generally file T1135 when the total cost amount of specified foreign property exceeds CAD 100,000 at any time in the year. Rental property can be specified foreign property, while primarily personal-use property is treated differently. The threshold is tested across the taxpayer's relevant foreign property, not only this apartment.

Can I finance the purchase with Canadian income?

Cash transfer from Canada and a Polish mortgage are different routes. Polish mortgage underwriting for non-resident CAD income is lender-specific and can change. Obtain a preliminary credit assessment before searching under a mortgage-dependent budget, and preserve a separate plan for currency and closing funds.

Does Warsaw Investor Care sell its own apartments?
