Yes. A French citizen can normally buy an apartment, house or ordinary urban real estate in Warsaw without obtaining Poland's foreign-purchaser permit. France is in the European Union and European Economic Area. Poland's Ministry of the Interior expressly states that acquisitions by EEA and Swiss nationals do not require the ministerial permit under Article 8(2): official Polish guidance for foreign buyers.
The permit exemption is the easy part. The real work is aligning a Polish title with the buyer's French tax residence, ownership structure, euro funding and remote-signing plan. A familiar French word such as notaire, compromis, indivision or PACS must not be assumed to produce the same result in a Polish deed. The owner, shares, marital-property evidence, price currency and authority to sign should be settled before the reservation becomes difficult to recover.

A French buyer normally needs no Polish acquisition permit and no Polish residence. Ownership transfers through a Polish notarial deed. A French account can fund the purchase, but the price is normally fixed in PLN. Polish rent and sale rules apply first to the Warsaw asset; a French resident can still face French reporting through form 2047, foreign-account disclosure through form 3916 and a potential IFI calculation. Decide the legal owner before choosing the apartment.
The Polish deed records an owner, not a French planning assumption
Permit status is personal. Ownership structure drives authority, tax, finance, succession and the future sale.

EEA status removes the permit, not the asset review
The official Polish exemption is broad for EEA nationals, covering real estate and relevant shares in property-owning companies. Agricultural land, border-area property and separately regulated assets still require specialist classification. For a Warsaw apartment, also distinguish separate ownership from cooperative rights, associated parking, storage and land shares.
France and Poland do not share every couple-property rule
The European Commission explains that France participates in the enhanced EU rules for international couples while Poland does not: official EU property-regime guidance. That is a warning against shortcuts, not a complete answer. The applicable law, recognition and deed wording require case-specific coordination.
Write down the intended owner, shares, marital or PACS position, funding source, debt, intended use and exit. Give the same page to the Polish notary, Polish buyer lawyer and French tax or notarial adviser. If they are answering different facts, the transaction is not yet controlled.

Record meters, keys and condition; transfer utilities and management; archive exchange records, tax cost, invoices, ownership and rent documents for Polish and French reporting.
Poland's Ministry of Justice provides free online viewing of the official land and mortgage register when the electronic number is known: Electronic Land and Mortgage Registers. The register is central evidence, but it is not the entire due-diligence file. A clean entry does not prove technical condition, lawful alterations, vacant possession or sound building finances.
The Polish notary should design the authority before France authenticates it
A correct apostille cannot repair a power of attorney that lacks authority required by the Polish transaction.
Draft in Warsaw first
The authority may need to cover reservation or preliminary agreements, the final deed, payment acknowledgements, mortgage documents, land-register filings, handover and utilities. Ask the actual Polish notary to approve the wording and form before the buyer signs anything in France. Buying real estate in Poland requires notarial form; the Polish government also notes that a property purchase contract is signed before a notary: official PCC and notarial guidance.
Authenticate only the final instrument
France's official portal explains that a French public document used abroad may require apostille or legalisation and that the French notarial system has handled these formalities since 2025: Service-Public apostille guidance. The Polish receiving authority decides what it needs. EU document-circulation simplifications do not cover every property authority.
Keep the French original, apostille or required authentication and Polish sworn translation together. Scan them before shipment, use tracked delivery and confirm the Polish notary has accepted the final set before the completion transfer is initiated.
A French frais-de-notaire shortcut will misstate the Warsaw budget
Build the cost stack under Polish tax and contract rules, then translate the total risk into EUR.

Poland's Ministry of Finance publishes the current 2% PCC rate for sales of real estate and specified rights: official PCC rates and limits. It separately confirms the first-home exemption for a qualifying individual who has not held the listed residential rights, subject to the inherited-share exception: official PCC exemptions. Eligibility is factual and should be documented before the deed.
Approve the maximum deed price in PLN, the maximum all-in acquisition cost in PLN and the maximum EUR cash outflow at a conservative exchange rate. A purchase is not affordable merely because the first number fits.
SEPA moves euros efficiently; the deed still needs the correct zloty result
Currency, beneficiary and completion timing must be managed as one contractual workstream.
Separate the payment rail from conversion
The European Commission explains that SEPA makes cross-border electronic euro payments work under common conditions: official SEPA overview. But Poland has not adopted the euro. A SEPA transfer can move EUR; it does not define the PLN deed amount, conversion provider, spread or the result credited to the seller.
Benchmark, then obtain an executable quote
The National Bank of Poland publishes current and archived EUR/PLN reference tables: NBP exchange-rate data. The NBP average is not necessarily a rate available for a private completion. Compare executable bank or regulated-provider quotes including all costs, settlement time and beneficiary mechanics.
Exact PLN obligation
Record the contractual PLN price, deposits already credited, balance, fees and any tolerance.
Verified beneficiary
Confirm seller, developer or escrow details through a second trusted channel before release.
Cleared-funds deadline
Work backwards through French bank limits, compliance, conversion and Polish cut-offs.
Rate and spread
Compare the all-in result, not an advertising rate detached from the transaction size.
Source of funds
Keep statements, sale or income evidence, conversion confirmation and payment trail.
Shortfall reserve
Maintain extra PLN and a contractual plan for a delayed or partially credited transfer.
Mortgage reality with French euro income
Polish supervisory guidance links mortgage currency to the currency in which the consumer receives most income or holds most financial assets: Polish Financial Supervision Authority. Euro income can therefore be relevant, but it is not a promise of a euro mortgage. Banks also assess residence, employer, contract, deposit, age, credit history, property, translation and their current cross-border appetite. Obtain a written lender decision before accepting a non-refundable financing deadline.
The Warsaw asset can create three different French reporting questions
Foreign income, a foreign bank account and IFI are separate tests with separate evidence and deadlines.

Rent: Poland taxes the Warsaw source
Poland's Ministry of Finance states that private rental is taxed on revenue at 8.5% up to PLN 100,000 and 12.5% above, with a special spouse threshold where conditions are met: official Polish rental guidance. This revenue-based Polish calculation should not be copied into a French return as if the tax bases were identical.
The France-Poland treaty provides that income from immovable property is taxable where the property is situated: official treaty published by the French tax administration. A French resident still needs the French reporting and treaty-relief analysis.
France: form 2047 is a reporting route, not a tax conclusion
The French tax administration identifies foreign property income in the 2047 process and explains that treaty mechanisms avoid double taxation: how foreign income is reported in France. The current form 2047 and notice should be used with the treaty and the buyer's facts.
A Polish operating account can trigger form 3916
France requires qualifying foreign accounts opened, held, used or closed during the year to be reported by French residents, normally using form 3916/3916-bis. The official page includes the scope and current filing route: French foreign-account guidance. Decide whether a Polish account is operationally necessary, then keep its complete identification file.
IFI tests the household and worldwide property base
The French administration states that a person fiscally resident in France can have French and foreign real estate in the IFI base, with filing relevant when net taxable real-estate wealth exceeds EUR 1.3 million: official IFI liability rules. New-resident relief, deductible debt, indirect holdings and professional-asset treatment require individual review.
Selling: Poland's calendar is not the whole answer
Poland's official rule generally places a private disposal outside Polish PIT after five years counted from the end of the acquisition or construction year: official Polish property-sale guidance. The treaty permits gains from Polish immovable property to be taxed in Poland. A French resident should still obtain the French reporting and relief analysis before signing a sale, because exchange rates, use, costs and French classification do not disappear when Polish PIT is nil.
Before completion, ask the French adviser how the planned owner will report rent, a Polish account, IFI value and a future sale. Capture the PLN and EUR evidence from day one. Reconstructing deed-day exchange rates, improvement invoices and foreign-account dates years later is avoidable risk.
The register, building and apartment must tell the same story
A permit-free purchase can still be commercially poor, technically defective or contractually exposed.
Owner and acquisition basis
Verify seller identity, authority, marital or corporate approvals and the right being transferred.
Mortgages and claims
Read every section and pending entry; define bank discharge and deletion mechanics.
Area and attached rights
Match apartment, storage, parking, common share and plans to legal documents and reality.

The official electronic land-register system lets a buyer inspect the legal register without charge when the number is known. Choose the micro-location and operating system together
The best remotely owned apartment is the one whose demand, maintenance and exit remain understandable from another country.
A Warsaw base or relocation home
Prioritise the actual weekly route: office, school or university, airport, rail, healthcare, parks, culture, accessibility and parking. A remotely managed rental asset
Model achievable long-term rent, vacancy, management, furnishing, repairs, building charges, Polish revenue tax and French reporting. A marginally lower headline yield can be rational when the apartment has dependable tenant demand, low maintenance complexity, professional access and a deeper resale audience. Price the cross-border workload, not only rent divided by purchase price.

Can a French citizen buy an apartment in Warsaw without a permit?
Yes. France is an EU and EEA member state. Poland exempts EEA and Swiss nationals from the ministerial permit normally considered for foreign acquisitions. The exemption does not replace title, seller, building, contract or source-of-funds checks.
Can a French citizen also buy a Warsaw house or urban land without the foreign-buyer permit?
Normally yes under the broad EEA exemption, but the exact asset still matters. Agricultural land, border-area property and other regulated categories can engage rules outside the ordinary Warsaw apartment route. Classify the land and title before paying a reservation amount.
Does a French notaire complete the Polish property transfer?
No. Ownership of Polish real estate transfers through a Polish notarial deed governed by Polish law. A French notaire may assist with a French power of attorney or related documents, but cannot replace the Polish notary or convert French purchase assumptions into Polish legal effects.
Can I buy the Warsaw apartment without travelling from France?
Often yes through a transaction-specific power of attorney. The Polish notary should first approve its content and form. The French instrument may then need apostille and Polish sworn translation. Do not sign a generic agency form before the Polish deed team confirms the exact route.
Are French documents automatically accepted in Poland without apostille?
Not every document. EU simplifications cover specified categories of public documents, not every property power of attorney. The receiving Polish notary decides what is required for the transaction. France moved apostille and legalisation work to the notarial system in 2025, so confirm the current French procedure after the final Polish draft is agreed.
Can the purchase price be paid directly in euros from France?
The payment can start from a French euro account, but the deed will normally fix a PLN purchase price. SEPA governs the euro payment rail; it does not choose the EUR-to-PLN rate, remove spreads or guarantee the net PLN received. Define conversion, beneficiary verification, timing and shortfall risk in writing.
Can a buyer earning in EUR in France obtain a Polish mortgage?
Possibly, subject to current bank policy and full affordability review. Polish mortgage rules connect the credit currency with the currency of the borrower’s main income or financial assets. Euro income is therefore relevant, but residence, employment, deposit, age, property and a bank’s cross-border policy can still decide eligibility.
How does a French tax resident report rent from a Warsaw apartment?
Poland may tax rent from Polish real estate. A French resident generally also reports foreign-source income through the French return process, including form 2047 where applicable, and applies the France-Poland treaty mechanism. The Polish and French tax bases are not interchangeable, so maintain one complete evidence file for both advisers.
Must a French resident declare a Polish bank account used for the property?
Generally yes where the account was opened, held, used or closed during the year and no narrow exception applies. French residents use form 3916 or 3916-bis with the annual return. Ownership of a Polish apartment does not itself create the declaration, but a Polish operating or rent account commonly does.
Can the Warsaw apartment be included in French IFI?
For a person fiscally resident in France, French IFI can include real estate situated in France or abroad when the household’s net taxable real-estate wealth exceeds the applicable threshold. Debt deductibility, company ownership, exemptions and the temporary rule for certain new French residents require individual calculation.
Should a married or PACS buyer decide ownership shares before the reservation?
Yes. The Polish deed must name the legal owners and shares, while the French marital or partnership regime can affect the economic and succession analysis. France participates in EU rules for international couples but Poland does not apply those enhanced-cooperation rules, so the cross-border result should be confirmed rather than assumed.
