Yes. A German citizen can buy an apartment, house or other real estate in Warsaw without obtaining the Polish foreign-purchaser permit. Germany is an EU member and German citizens are nationals of the European Economic Area. Poland's Ministry of the Interior states that EEA and Swiss nationals acquiring real estate, or shares in property-owning companies, are exempt from the ministerial permit under Article 8(2): official guidance on foreign acquisition of Polish real estate.
The exemption removes a major administrative barrier, but it is not a due-diligence certificate. The seller's authority, the Polish land-and-mortgage register, mortgages, pending claims, building condition, planning, contract protections and source of funds still have to be checked. A non-EU spouse buying jointly requires a separate nationality analysis, and agricultural land or another regulated asset can carry rules outside the general foreign-buyer permit.

A German buyer normally needs no acquisition permit and no Polish residence. Ownership transfers through a Polish notarial deed. The purchase price is normally defined in PLN, even when the buyer funds it from a euro account. Poland taxes the Polish property; a German tax resident may still need German reporting and treaty analysis. A Polish five-year sale rule must never be confused with Germany's separate domestic ten-year period.
The familiar concepts are not legally interchangeable
Poland also uses a notary and a public register, but the transaction is governed by Polish law and Polish documents.

Polish księga wieczysta is not a German Grundbuch copy
Both systems publicly record real-estate rights, but their sections, procedures and legal effects must be read under their own law. Poland's Ministry of Justice explains that the Polish register has four sections covering the property and attached rights, ownership, rights or restrictions, and mortgages: official land-and-mortgage-register guidance. Check the live register and all pending mentions, not only a PDF supplied by the seller.
A Polish notary does not replace buyer-side advice
The notary performs a public function and executes the deed, but the buyer still needs someone to test the transaction against the buyer's commercial objectives and risks. Article 158 of the Polish Civil Code requires the agreement transferring real-estate ownership to be in notarial-deed form; the official text is available through Poland's ELI legal database.
A German spouse's exemption does not automatically attach to a non-EEA spouse. The ownership share and marital-property regime can affect the route. Put a written permit analysis ahead of the reservation agreement, not behind it.

The permit exemption saves time only when the rest of the transaction is organised before a deposit becomes non-refundable.
Write the brief in PLN and EUR
Define own use or investment, location constraints, maximum PLN price, acquisition-cost reserve, renovation or finishing budget, euro exposure and hold period.
Classify the buyers and ownership
Confirm citizenship, tax residence, marital status, proposed shares, funding ownership and whether an individual or company will acquire the property.
Search Warsaw by outcome
Compare micro-location, transport, building quality, running cost, layout, rental audience, competing supply and resale liquidity instead of chasing a district label.
Review the legal and physical asset
Check the current register, seller authority, claims, mortgages, planning or developer documents, arrears, occupancy, technical condition and future works.

A German power of attorney must be designed for the Polish deed
Remote completion is often practical, but authentication and legal form are separate questions.
Use the completing notary's draft first
The Polish lawyer and notary should define the exact authority required for the property, price, preliminary and final agreements, payments, land-register filings and handover. Only then should the buyer execute the document before the appropriate German notarial authority. Germany's Federal Foreign Office explains that an apostille confirms the authenticity of the signature, seal and authority on a public document, while the receiving foreign authority determines what is required: International use of German public documents.
EU simplification has a defined boundary
EU Regulation 2016/1191 removes apostille formalities for listed public documents concerning matters such as birth, marriage, residence and nationality. It covers authenticity, not automatic recognition of every document's content or effects. The official scope is summarised on EUR-Lex. A transaction-specific property power of attorney should therefore never be assumed to be exempt without confirmation from the Polish notary.
Exact authority
Grant only the powers required for identified agreements, property, payments, filings and handover.
German execution route
Confirm German notarisation and any apostille or equivalent authentication before the appointment.
Polish translation
Ask the completing notary whether a sworn translation and interpreter are required for each document and buyer.

Match passports, addresses, marital status and name spellings across contracts, banks and registers.

Poland's Ministry of Finance publishes the normal 2% PCC rate for sales of real estate and relevant residential rights: official PCC rates and limits. A qualifying first-home purchase on the resale market may be exempt; the Polish government explains the ownership-history test and the limited inherited-share exception in its first-home PCC guidance.
Add the PLN price, tax, notary and court costs, independent advice, renovation or finishing, furniture, bank and conversion cost, insurance, vacancy and reserve. SEPA solves the payment standard, not the currency exposure
The buyer's obligation is the PLN amount in the deed. The bank route must deliver it in full and on time.
Control the conversion point
SEPA standardises euro payments across participating countries. The European Commission describes the common framework in its SEPA overview. A German buyer still has to decide where EUR becomes PLN, compare the net PLN received, hold an exchange-rate buffer and align transfer limits, cut-off times and cleared-funds rules with the deed.
Keep account statements, conversion confirmations, beneficiary instructions and source-of-funds evidence in one transaction file. Reconfirm any changed account detail through a known independent channel before sending a large payment.
Euro income does not guarantee a Polish mortgage
Polish banks make their own current credit decisions. They assess residence, employment, euro income, deposit, credit history, age, documentation and the property. The Polish Financial Supervision Authority states that mortgage credit should be granted or linked only to the currency in which the borrower earns most income or holds most financial assets: KNF guidance on mortgage currency risk.
Obtain a written lender or broker assessment before signing a financing-dependent deadline. Confirm translated income records, German tax returns, account history, valuation, deposit, insurance, early-repayment conditions and the consequences if the chosen property is declined.
Fix in writing: the PLN amount, beneficiary, bank reference, last safe sending time, acceptable payment evidence, cleared-funds requirement and the contractual result of a late transfer. A low transfer fee is irrelevant if the wrong PLN amount arrives.
One property, two calculations and a binding bilateral treaty
Polish payment does not remove German filing analysis, and German domestic holding periods do not override Polish source-country law.

Polish private rental
Poland currently taxes private rental revenue at 8.5% up to PLN 100,000 and 12.5% on the excess, subject to detailed rules and the special spouse threshold where applicable. The current method and deadlines are published by the Polish Ministry of Finance.
German income-tax law separately identifies rental and leasing income in §21 EStG. The Polish and German calculations do not use the same taxable base, so preserve gross rent, recharged utilities, costs and exchange-rate evidence even when Poland's private-rental tax is based on revenue.
Selling: five years is not ten years
Poland's official rule can require a PIT-39 filing for a private sale before five years measured from the end of the acquisition or construction year; after that period the standard private disposal is outside Polish PIT. See the current Polish property-disposal guidance.
Germany's domestic §23 EStG defines a separate ten-year period for private sales of land and apartments, with specified own-use exceptions. That does not mean Germany automatically taxes every Polish sale within ten years: the treaty, residence and the facts control the final result. It means the buyer must never plan an exit using only Poland's calendar.
The binding Poland-Germany double-tax treaty is published by both the German Federal Ministry of Finance and Poland's official ELI database. It allows Poland to tax income and gains connected with Polish immovable property and provides the mechanism for Germany to relieve double taxation. A German resident can still have a German declaration obligation. ELSTER's official Anlage AUS guidance expressly covers foreign income whether it is taxable in Germany, credited or treaty-exempt with possible progression treatment.
Have a Polish adviser calculate the Polish source-country result and a German adviser apply German law and the treaty. Give both the same deeds, ownership shares, rent ledger, costs, use history, conversion records and Polish-tax evidence. Do this before the first lease and before agreeing a sale.
Legal certainty, building quality and exit liquidity must agree
A correct register entry cannot make a technically poor apartment or a weak investment commercially sound.
Identity and authority
Confirm the owner, marital or corporate approvals, acquisition basis and legal ability to transfer.
Claims and mortgages
Read every section, pending mention, enforcement risk and the exact mortgage-release mechanics.
Apartment and attached rights
Match unit area, storage, parking and common share to the deed, plans and physical reality.
Condition and capital works
Inspect the unit and common parts; check management, arrears, reserve fund and planned expenditure.
Tenants and handover
Identify occupants, leases, registered-address issues, utilities, keys and enforceable vacancy conditions.
Future environment
Review credible development affecting light, access, noise, views, tenant demand or resale value.
Official transaction data can support price analysis. Poland's Geoportal describes the Real Estate Price Register as information derived from notarial deeds and maintained by local authorities: Real Estate Price Register. A valid comparable still needs adjustment for transaction date, title, floor, condition, outdoor space, parking and exact micro-location.
Choose the property around the German buyer's real operating model
Regular personal use, relocation and remotely managed investment require different buildings and different post-purchase systems.
A Warsaw base or relocation home
Prioritise the real weekly route: work, school or university, airport and rail access, healthcare, accessibility, parking, noise, green space and year-round services. A remotely managed rental asset
Model achievable long-term rent, vacancy, management, furnishing, repairs, building charges, Polish revenue tax and German reporting before quoting yield. For an owner based in Germany, a slightly lower headline yield can be rational when the apartment has simpler maintenance, professional management access, reliable tenant demand and an easier resale audience. Price the workload and operational risk, not only the gross rent.
Questions to settle before a Warsaw reservation payment

Can a German citizen buy an apartment in Warsaw without a permit?
Yes. German citizens are EU and EEA nationals, so Poland's broad exemption removes the need for a permit from the Minister of the Interior when they acquire Polish real estate. The title, property type, seller and every co-buyer's citizenship still require normal due diligence.
Can a German citizen also buy a house or land in Warsaw without that permit?
The EEA exemption is broader than the apartment-only exemptions available to many non-EEA buyers, so a German citizen normally does not need the foreign-purchaser permit for a house or urban land. Agricultural land and other regulated assets can still be subject to separate acquisition rules and specialist review.
What if the German buyer purchases jointly with a non-EU spouse?
Each acquirer must be classified separately. German citizenship does not automatically extend the EEA permit exemption to a non-EU spouse or partner. Confirm the planned shares, marital-property regime and the second buyer's individual permit or exemption position before reservation.
Is the Polish notarial process the same as buying through a German Notar?
No. Both systems use notaries, but the applicable law, deed, land register, payment mechanics, document language and professional roles are Polish. A German buyer should use independent Polish buyer-side legal advice and should not assume that familiar German terminology has the same legal effect.
Can the Warsaw purchase be completed remotely from Germany?
Often yes. The Polish notary must approve a transaction-specific power of attorney before it is signed in Germany. The required German notarial form, apostille or other authentication and Polish sworn translation depend on the exact document; EU public-document simplifications do not automatically validate every property power of attorney.
Does German Grunderwerbsteuer apply to a Warsaw apartment?
The acquisition is taxed under Polish transaction rules, not as a German domestic property purchase. A Polish resale is normally subject to 2% PCC unless an exemption applies, while a developer sale is usually VAT-taxed. German tax reporting can still arise later, so the buyer should confirm the full cross-border position with advisers in both countries.
Can I pay for the Warsaw apartment from a German euro account?
Yes, but the deed will normally require a defined PLN amount. A SEPA euro transfer is only the payment rail; it does not determine the EUR-to-PLN exchange rate or guarantee the net PLN received. Confirm the conversion point, beneficiary, bank cut-off and cleared-funds requirement before completion.
Can a buyer with German euro income obtain a Polish mortgage?
Possibly, subject to the lender's current policy. Polish supervisory guidance links mortgage currency to the currency of the borrower's main income or financial assets, while banks also assess residence, employment, deposit, age, credit evidence and the property. Obtain a written assessment before relying on credit in a contract.

Do Poland's five-year sale rule and Germany's ten-year rule produce the same result?
No. Poland counts its private-sale period from the end of the acquisition or construction year, while German domestic law contains a separate ten-year rule and own-use exceptions. The bilateral treaty and the seller's tax residence must then be applied. Never use one country's holding period as the answer for the other country.
