Yes - an Israeli citizen can buy property in Warsaw. Israel is outside the EEA, so an Israeli buyer starts under Poland's rules for non-EEA purchasers. The result is still straightforward for the most common transaction: Poland's Ministry of the Interior lists the acquisition of an individual residential unit among the exemptions available to foreign citizens regardless of nationality. The official rules, exemptions, supporting documents and current PLN 1,570 permit fee are published in the Ministry's foreign-property guidance.
The decisive question is what the land register says you are acquiring. A self-contained apartment with its own land-and-mortgage-register entry is normally permit-exempt. A house with a plot, development land, an unusual co-ownership share or a separately structured garage right can produce a different answer. The legal classification belongs at the start of the search, not after a deposit has been transferred.

For a normal Warsaw apartment, an Israeli buyer usually needs neither Polish residence nor a ministerial acquisition permit. A house or land needs a separate permit review. A purchase can often be completed from Israel under a notary-approved power of attorney. Polish tax applies to the Warsaw property; Israeli tax depends primarily on Israeli tax residence, not passport alone.

Polish ancestry is important, but it is not a shortcut
Many families in Israel have Polish roots. That can be relevant, but a grandparent born in Poland does not by itself establish the buyer's current legal status. The Polish Embassy in Israel explains that a person without a current Polish passport or ID may need a formal procedure to confirm citizenship, including civil-status records and apostilled Israeli documents: Poland in Israel - confirmation of Polish citizenship. Resolve this before the notary drafts the acquisition documents.
If the buyer is purchasing only as an Israeli citizen, use the non-EEA analysis consistently. If Polish citizenship is formally confirmed, the acquisition status changes, but tax residence, source-of-funds checks and Israeli reporting do not automatically disappear.
A listing described as an "apartment" may include a commercial unit, land share or separate garage right. Use the correct Israeli apostille route
Poland and Israel are parties to the Hague Apostille Convention. The Polish Embassy confirms that Israeli notarized documents receive the apostille through the competent Israeli courts, while other public documents may be handled by the Ministry of Foreign Affairs: Poland in Israel - apostille guidance. A digital apostille is not just a printout. The Israeli authority notes that a printed copy of a digital certificate has no legal validity abroad. Ask the Polish notary which original or electronic package must be delivered for the deed.
Remote-closing checklist

- Names, passport numbers and transliterations match every document.
- The Israeli notary and apostille route fit the document type.
- A Polish sworn translation is prepared in the form accepted for the deed.
- The authority is limited to the necessary contract, payment, filing and handover acts.

The Ministry of Finance lists a 2% PCC rate for real estate and specified residential rights: official PCC rates and limits. Maximum notary remuneration is regulated separately under the current notarial-fee regulation. The actual amount depends on the deed and additional applications.

Funding is a delivery problem, not an exchange-rate headline
The seller must receive the agreed PLN amount on time and from a documented source.
Build the conversion plan before signing
Some providers quote ILS directly to PLN; others route through EUR or USD. A two-stage conversion is not automatically cheaper. Compare rate, spread, sending and receiving fees, transfer limits, value date and who bears intermediary-bank deductions. The National Bank of Poland exchange-rate tables are a reference, not a guaranteed retail execution rate.
Use a written funding calendar for reservation, preliminary agreement, final deed and fit-out. Keep a buffer for exchange movement and bank compliance review. Never plan a notarial closing around a same-day international transfer that has not been tested.
Prepare source-of-funds evidence once
- Recent statements showing accumulation of purchase funds.
- Employment, business, dividend or investment-income evidence.
- Sale agreements, inheritance or gift records where relevant.
- Tax returns and proof of tax payments where requested.
- A clear chain between the buyer, sending account and Polish recipient.
- Certified translations if a bank or authority requires them.
Mortgage reality for income earned in ILS
A Polish mortgage is possible in selected cases, but it should never be assumed. Bank policies differ on non-resident borrowers, Israeli documentation, income currency, required equity and acceptable collateral. Poland's financial supervisor requires banks to control mortgage currency risk and apply conservative treatment to multi-currency income under Recommendation S. What the official sources establish
Poland's Ministry of Finance confirms that private rental is taxed at 8.5% up to PLN 100,000 of annual revenue and 12.5% above that amount: official private-rental guidance. The Israel Tax Authority states that Israeli residents are taxed on income generated in Israel or abroad on its official income-tax page. Its current annual-report service includes Form 1324 for income from abroad and foreign tax paid. Form 5328 is different: the Authority explains that it is a requested declaration covering sources of income and assets in Israel and abroad, not a form automatically filed by every owner: Israel Tax Authority - Form 5328.
The treaty must be applied to the actual taxpayer and income. Use the official Poland-Israel double-taxation agreement and obtain advice on foreign-tax credits, Israeli currency conversion, deductible expenses and the sale calculation. Direct ownership, a Polish company and a partnership are not interchangeable.
Israel publishes a ten-year foreign-income exemption for new immigrants and qualifying veteran returning residents, including foreign rent and capital gains, subject to status and timing: Ministry of Aliyah and Integration - tax-benefit consultation. Do not assume the exemption applies without confirming the individual's date, status and reporting position.

Can an Israeli citizen buy an apartment in Warsaw?
Yes. Israeli citizens may acquire property in Poland. A standard, separately registered residential apartment is normally covered by the statutory exemption from the ministerial permit requirement, but the exact title and any linked garage, storage or land rights must be checked before reservation.
Does a buyer from Israel need Polish residence to purchase?
No. Polish residence is not a general condition for buying a standard Warsaw apartment. Residence history can matter for certain personal permit exemptions, but it is separate from the usual exemption for an individual residential unit.
Does Polish ancestry remove the foreign-buyer rules?
Ancestry alone does not prove current Polish citizenship. A valid Polish passport, ID card or formal citizenship confirmation is needed. Buyers who may already hold Polish citizenship should resolve that status before contracts are prepared because it can change the legal classification of the acquisition.
Can the Warsaw purchase be completed remotely from Israel?

Where is an apostille obtained for an Israeli power of attorney?
For an Israeli notarized document, the apostille authenticating the notary's signature is issued through the competent Israeli court system. Other Israeli public documents may follow a Ministry of Foreign Affairs or electronic apostille route, depending on the document type.
What purchase tax usually applies to a resale apartment?
A resale purchase is normally subject to 2% Polish PCC unless a statutory exemption applies. A developer sale is normally VAT-taxed instead, with VAT included in the gross price. The notary should confirm the treatment of the exact transaction.
